LITIGATION PRACTICE

John R. Holsinger has handled hundreds of complex commercial litigations in the New Jersey and New York federal and state courts during his 32 years of practice. The cases involved a wide range of legal issues including antitrust, environmental, corporate, contract, commercial landlord/tenant, labor and employment, unfair competition, trademark, and partnership and shareholder issues.   The largest cases involved national and international companies in disputes involving tens of millions of dollars of potential damages.   The businesses and industries included manufacturing, consumer products, brokers, real estate investments, medical devices, banking, distributorships, investment banking, and professional services.
 
He has handled numerous lengthy jury and bench trials.   Some of the more significant include:  a six-day jury trial about the alleged breach of a shopping center lease by an anchor tenant; a week-long federal court jury trial about lender liability arising from the termination of a banking relationship with a New York Stock Exchange specialist firm; a multi-day bench trial about deductibility of mining exploration expenses; a week-long jury trial about the sale of a closely held business. 
 
Many cases are resolved before trial on motion to the court after lengthy pretrial discovery and motion practice.  For example, John R. Holsinger won a significant victory for clients by summary judgment granted by the court in an antitrust challenge to beer distribution practices in New Jersey.  
 
Other major cases he has handled include:  an antitrust challenge to the distribution practices of a consumer products company; a fraud and breach of contract case (also involving federal racketeering allegations) about the move of a manufacturing facility from New Jersey to South Carolina; wrongful termination claims brought by a bank employee who had been terminated for embezzlement; United States Tax Court litigations involving a variety of federal income tax issues; shareholder and partnership disputes about mismanagement, fraud and oppression of minority business owners;  employment discrimination cases; franchising and distributorship disputes; and cases involving employee breach of non-compete and confidentiality agreements.
 

He also serves as local counsel to out-of-state firms on significant New Jersey federal and state court cases.  
In addition to this litigation background, John R. Holsinger has consulted with corporate and individual clients, some for decades, about a wide range of legal issues including:  franchising; the formation of small businesses; leasing; marketing and distribution matters; financing; and personal matters.
